Ballard charged and found guilty of "false and fraudulent advertising and applied knowingly and in reckless and wanton desregard of their truth or falsity"; fined $30 and costs; Sept. 12, 1916; Swaim's Panacea owed much of its success to delicious flavour; symbol for product was of Hercules killing the Hydra; had several testimonials from important professionals like Dr. W. Gibson and Dr. N. Chapman; basically a sarsaparilla syrup with gaultheria (oil of Wintergreen), giving a very pleasant taste, and mercury, despite his claim that it cured mercurial poisoning; James Ballard produced many patent medicines under his name and acquired the rights to others which were well-established in public favour, incuding Swaim's Panacea
